ARBITRATION NOTICE: These Terms contain an arbitration provision. Except for certain types of disputes described in the arbitration section below, you and DIAL agree that disputes between us will be resolved by binding, individual arbitration, and you waive your right to participate in a class action lawsuit or class-wide arbitration.
Welcome to PurpleConnect! These Terms of Service ("Terms") constitute a legally binding agreement between you and DIAL ("Company," "we," "us," or "our") governing your access to and use of the PurpleConnect application, website, and related services (collectively, the "Service").
By creating a PurpleConnect account or using any part of the Service, you accept and agree to be bound by these Terms. We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.

By posting Your Content on PurpleConnect, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works from, distribute, publicly display, publicly perform, and otherwise exploit Your Content in connection with operating and providing the Service. This license ends when you delete Your Content or your account, except to the extent Your Content has been shared with others who have not deleted it.
We reserve the right (but have no obligation) to review, monitor, and remove Your Content at our sole discretion, for any reason, without notice. We may remove content that violates these Terms or that we find objectionable.
PurpleConnect contains content provided by other users. We do not control, endorse, or guarantee the accuracy, integrity, or quality of such content. You understand that by using the Service, you may be exposed to content that is offensive, indecent, or objectionable. Under no circumstances will we be liable for any content posted by other users, including any errors, omissions, or losses resulting from such content.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. DIAL DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS USERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS USERS.

PurpleConnect may offer products and services for purchase ("In-App Purchases"). If you choose to make In-App Purchases, you acknowledge and agree that additional terms may apply. All purchases are final and non-refundable, except as required by law.
If you purchase a subscription, it will automatically renew at the end of each subscription period unless you cancel before the renewal date. You can manage or cancel your subscription through your device's account settings or through the Service.
We may offer free trials of premium features. If you do not cancel before the free trial ends, you will be charged for the subscription at the then-current rate.
Generally, all purchases are non-refundable. However, if you believe you are entitled to a refund, please contact our support team. Refund requests will be handled in accordance with our refund policy and applicable law.
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by DIAL, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.
"PurpleConnect," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DIAL. You may not use such marks without our prior written permission.
You may terminate your account at any time by deleting your account through the settings in the app or by contacting us. Upon termination, you will not be entitled to any refund for purchases made.
We may terminate or suspend your account at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
Upon termination, your license to use the Service will immediately terminate. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless DIAL and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising from or relating to your use of the Service, Your Content, your violation of these Terms, or your violation of any rights of another.
Before filing a claim against DIAL, you agree to try to resolve the dispute informally by contacting us at legal@purpleconnect.app. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or DIAL may bring a formal proceeding.
You and DIAL agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court, except that (1) you or DIAL may assert claims in small claims court if your claims qualify, and (2) you or DIAL may seek equitable relief in court for infringement or other misuse of intellectual property rights.
YOU AND DIAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in the United States county where you live or work, or any other location we agree to.
These Terms will be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. To the extent that any action relating to these Terms or the Service is permitted to be brought in court, such action will be brought in the state or federal courts located in Riley County, Kansas.
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and DIAL concerning the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
